Welcome to The Maxi Ride (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your,” or “Rider”) and The Maxi Ride governing your access to and use of our website, storefront, and rental services for electric scooters (collectively, the “Services”).
By creating a reservation, paying any amount, taking possession of a scooter, or otherwise using the Services, you agree to these Terms.
Eligibility & Accounts

Age & competence. You must be 18+ to rent or ride our scooters. (While NYC allows privately owned e-scooters from age 16 with helmet requirements, The Maxi Ride sets its rental eligibility at 18+.) (New York City Government)

ID & verification. A valid, government-issued photo ID and a matching credit/debit card are required at pickup. We may deny service if we cannot verify your identity.

One rider per scooter. Passengers are not permitted.

Account accuracy. Information you provide must be true and up-to-date. We may suspend or terminate access for any violation or suspected fraud.
Reservations, Pricing & Payments

Reservations. A reservation is confirmed after successful checkout. Availability is not guaranteed until payment is processed.

Pricing. Prices are listed in USD and may vary by model, date, and duration. Taxes and fees are shown at checkout.

Security deposit / card hold. A refundable hold may be placed on your payment method at pickup to cover potential loss or damage. The hold is released after timely return and inspection (see §8).

Payment authorization. You authorize us to charge your card for rental fees, taxes, add-ons, late fees, excess time, damage, loss/theft, cleaning, and any other amounts due under these Terms.

Promotions. Discounts or promo codes are single-use, non-transferable, and may not be combined unless expressly stated.
Cancellations, No-Shows & Extensions

Cancellations. You may cancel according to the policy shown at checkout (e.g., free until X hours before pickup; otherwise a fee may apply).

No-shows. If you fail to arrive within [30/60] minutes of your scheduled pickup time, your reservation may be canceled and fees may apply.

Early returns. Returning early does not guarantee a refund for unused time.

Extensions. Text or call us before your return time to request an extension. Approval depends on availability; additional charges apply at the then-current rate.
Pickup & Return (East Village Only)

Pickup. All rentals are pickup-only from our East Village location: [Full Address] during posted business hours. Bring your ID and payment card used to book.

Return. Return to the same location by the scheduled time. Late returns incur fees (see §7).

After-hours. If we offer an approved after-hours option, follow the written instructions. You are responsible for the scooter until our staff confirms secure handoff.
Rider Responsibilities & Local Law

Where you can ride. In NYC, e-scooters may be used in bike lanes and on streets with speed limits ≤ 30 MPH. Sidewalk riding is prohibited. (New York City Government)

Helmets. Helmets are required for riders 16–17 and strongly recommended for all riders. We provide a helmet with each rental. (New York City Government)

Traffic compliance. Obey all traffic laws, signals, and posted signs. Yield to pedestrians and ride defensively.

One rider per scooter. No passengers, towing, or carrying items that interfere with safe operation.

No intoxication. Do not operate under the influence of alcohol, drugs, or medications that impair ability. (Industry operators—e.g., Lime/Bird—prohibit impaired riding.) (Lime Micromobility)

Weather. Use extra caution in rain, snow, or low visibility. We may cancel or suspend rentals for safety.
Care, Charging & Prohibited Uses

Care. Treat scooters and accessories with care. Do not modify, disassemble, or repair.

Charging (multi-day rentals). Use only the provided charger indoors, away from flammable materials. Never leave batteries charging unattended overnight.

Parking. Park upright without blocking sidewalks, curb ramps, bus stops, doorways, or ADA access. Follow local signage.

Prohibited uses. Off-road use; stunts; racing; commercial delivery; sub-renting; riding on highways/bridges where prohibited; riding on sidewalks; riding with a passenger; or any use that violates law or these Terms.
Late Fees, Replacement & Cleaning

Late returns. A [fee, e.g., $XX/hour] applies for late returns, plus the applicable daily rate after [X] hours late.

Loss/theft. You are responsible from pickup until confirmed return. If a scooter or accessory is lost or stolen, you may be charged up to the replacement value (e.g., scooter up to [$1,500–$2,000], helmet [$XX], lock [$XX]), plus administrative costs. Cleaning. Excessive dirt, odors, or biohazards may incur a cleaning fee of [$XX].
Damage, Inspection & Charges

Pre-ride inspection. Before riding, check brakes, tires, throttle, lights, and general condition. Do not ride if any issue is noticed; report it immediately.

Damage during rental. You are responsible for damage beyond normal wear and tear. We may charge repair costs, parts, and labor at reasonable market rates.

Post-return inspection. We will inspect after return. If we discover damage or missing items, we may notify you and charge your card accordingly.

Security deposit / hold release. Holds are released after inspection and settlement of any amounts owed. Bank processing times vary.
Incidents, Tickets & Enforcement

Accidents. If you are in an accident, stop in a safe place, contact 911 if needed, and notify us at [phone] as soon as reasonably possible.

Police reports. Cooperate with law enforcement and file a report if required.

Tickets & impounds. You are responsible for any citations, fines, impound fees, tolls, or penalties incurred during your rental.
Safety Acknowledgment & Assumption of Risk
Riding an e-scooter involves inherent risks (including falls, collisions, and battery risks). You acknowledge that you understand these risks and assume full responsibility for your use, including to the maximum extent permitted by law. Insurance
The Maxi Ride does not provide personal health, accident, or property insurance for riders. You are responsible for your own coverage. Our business insurance (if any) does not replace your personal insurance obligations.
Limitation of Liability
To the fullest extent permitted by law, The Maxi Ride and its owners, employees, and agents will not be liable for indirect, incidental, special, punitive, or consequential damages; lost profits; or property damage arising out of or related to your use of the Services or scooters. Our total liability to you for any claim will not exceed the amounts you paid for the rental giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless The Maxi Ride and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of a scooter; (b) your breach of these Terms or applicable law; or (c) your negligence or misconduct.
Privacy & Communications

Privacy. Our collection and use of personal data are described in our Privacy Policy (incorporated by reference).

Communications. You consent to receive service-related calls or texts at the number you provide (e.g., pickup reminders, extension approvals). Message/data rates may apply. Opt-out may limit our ability to provide time-sensitive updates.
Prohibited Conduct on the Platform
Do not misuse our website or systems (e.g., scraping, interfering with operations, bypassing security, fraudulent reservations, or payment abuse). We may suspend or cancel accounts for violations.
Termination & Suspension
We may refuse service, cancel reservations, or terminate access at our discretion for safety, nonpayment, suspected fraud, or policy violations. You remain responsible for amounts accrued before termination.
Disputes, Governing Law & Venue

Governing law. These Terms are governed by the laws of the State of New York, without regard to conflict of law rules.

Venue. Courts located in New York County, NY shall have exclusive jurisdiction, unless otherwise required by law.

Informal resolution. Contact us first to try to resolve any dispute.

Arbitration (optional clause). If included after legal review: Any dispute that cannot be resolved informally will be resolved by binding arbitration on an individual basis, and class actions are waived. (Insert AAA/JAMS rules, seat, and costs language as approved by counsel.)
Force Majeure
We are not responsible for delays or failure to perform due to events beyond our reasonable control (e.g., severe weather, power outages, public safety orders, strikes).
Changes to the Services or Terms
We may update the Services and these Terms at any time. Material changes will be posted with a new “Last updated” date. Continued use after changes constitutes acceptance.
Entire Agreement & Miscellaneous
These Terms (plus incorporated policies) are the entire agreement between you and The Maxi Ride. If any provision is held invalid, the remainder remains in effect. Our failure to enforce a provision is not a waiver.
